On July 12, 2024, the Regulation of the European Parliament and of the Council (EU) regulating artificial intelligence systems and AI models, commonly known as the AI Act, was published. It defines the principles for the development, implementation, and use of artificial intelligence in European Union countries. The provisions of the Regulation are coming into force gradually and cover both providers of AI-based solutions and entities that use them.
A ban on the use and marketing of particularly dangerous AI systems has been in effect since February 2, 2025. Violation of this ban can result in significant administrative fines (up to €35 million or 7% of the previous year’s total turnover). Employers are also required to provide employees with the knowledge and skills necessary to perform their duties in the use of AI.
In August 2025, further obligations contained in the AI Act came into force, which aim to ensure that the development of artificial intelligence takes place responsibly and without violating European values.
According to research, up to 70% of Poles may regularly use AI at work using publicly available tools. Meanwhile, fewer than half of employers have developed and implemented internal regulations regarding the use of AI tools at work.
As the final components of the AI Act Regulation come into force in August 2026, all companies using artificial intelligence will be required to disclose which tools they use and demonstrate that they do so in compliance with the AI Act requirements.
Special obligations will apply to entities that use AI tools to process sensitive data and to entities that use these tools to make decisions of significant importance to humans, e.g. in recruitment processes.
