Are you setting up a company in Poland? You need to have e-Delivery


If you are setting up a company or sole proprietorship (JDG) in Poland after 1  January 2025, you are required to set up an individual e-Delivery address. Entities registered before 31 December 2024 will also soon be subject to this obligation. Check what you need to do to meet the new requirements.

What is e-Delivery for?

E-Delivery is a system that allows for the secure exchange of documents with public administration in electronic form. Since the launch of this solution by the Ministry of Digital Affairs, state authorities have been required to use e-Delivery in contacts with entrepreneurs.

How to prepare for e-Delivery?

What do you need to do?

1. Submit an application to the Minister of Digital Affairs for an e-Delivery address.

2. Select an e-Delivery service provider – it can be Poczta Polska (or one of the approved private providers).

3. Designate an e-Delivery mailbox administrator in your company.

Since when does e-Delivery apply?

As of 1 January 2025, the following entities must have an e-Delivery address:

  • all newly established commercial law companies
  • all entities newly registered in CEiDG, including sole proprietorships (JDG)
  • persons performing professions of public trust, such as attorneys, legal advisers, tax and restructuring advisors, patent attorneys and notaries.

Companies established before 31 December 2024 have the following deadlines for implementing e-Delivery:

  • 1 April 2025 – companies registered in the National Court Register
  • 1 October 2026 – entities registered in the CEiDG

Handling an e-Delivery mailbox

Handling an e-Delivery mailbox may pose several challenges for entrepreneurs:

  • Regular checking obligation: e-Delivery is deemed delivered after 14 days even if the recipient has not read the message. This means that the mailbox must be constantly monitored so as not to miss important official letters.
  • Necessity to appoint an administrator: In the case of companies and other larger entities, a person responsible for handling the mailbox must be formally appointed, which involves additional responsibilities and the risk of organizational errors.
  •  Lack of user experience: Some people, especially in small companies, may have difficulty using the new system, which requires time to learn and adapt to new procedures.

To avoid problems, it is worth implementing appropriate procedures and ensuring regular checks of the mailbox.
