Family foundation – a tool for succession and protection of business assets

Introduced in May 2023, the family foundation has quickly gained popularity among Polish entrepreneurs, becoming the answer to their long-standing concerns about the future of their companies and the security of their assets. More than 2,200 registered foundations indicate a strong demand for a stable succession planning and risk protection tool.

A family foundation is a legal entity to which the founder contributes assets to serve the designated beneficiaries according to his or her will. It enables the separation of ownership and management, which is crucial for the multi-generational survival of family businesses. With a foundation, it is possible to transfer the business in an orderly manner, protect against the division of assets, protect against claims and provide benefits for relatives, while allowing for the continued management of the business and a favourable tax environment.
