Shield 3.0 – key assumptions


On 15 May 2020, the Act on the Anti-Crisis Shield 3.0 entered into force. Its task is to mitigate the direct consequences of the epidemic and to prepare both the economy and the administrative structures for the challenges that will follow the extinction of epidemic outbreaks.

The main assumptions of Shield 3.0 are:

  • extension of the exemption from the obligation to settle the unpaid social security contributions. In a situation in which the income would be higher than 300% of the forecasted average monthly remuneration, the possibility to take advantage of the aid will depend on the income obtained in the first month for which the application for exemption from paying contributions is submitted, which cannot be higher than PLN 7000
  • the possibility for sole proprietors to be exempt from April and May contributions, even if they have been paid
  • downtime benefit for an entrepreneur who started operating before 1 April 2020
  • the possibility of obtaining an additional childcare allowance, even if a nanny or day carer is unable to provide care due to COVID-19
  • increasing the amount of the income criterion entitling to benefits from the alimony fund (family income per family member) to PLN 900
  • increasing the amount of remuneration for work free from execution by 25% for each member of the family who has no income and is dependent on the member of family who is employed
  • the application of an exceptional exemption from the requirement to obtain a work permit during a state of epidemic or state of epidemic hazard and 30 days after their revocation in sectors in which seasonal work permits are required
  • waiver, in certain cases, of the foreigner’s obligation to submit documents in person when applying for a Polish visa
  • the extension of waste disposal decisions validity for those whose validity would expire during a state of epidemic or epidemic hazard
  • extension of the deadline from 30 April to 30 September 2020 to carry out an external audit for 2019 of the entrepreneurs who recycle, other recycle processes of packaging waste or export such waste
  • introduction of sanctions for the invalidity of contracts of the so-called transfer of ownership to secure residential property used by a consumer in certain cases
  • providing capital to Agencja Rozwoju Przemysłu S.A. with an amount of up to PLN 900 million (from the Reprivatisation Fund), intended in particular as support for entrepreneurs
  • postponement of the deadlines for the share dematerialisation procedure – expiry of paper share documents – 1 March 2021
  • conducting hearings or open hearings in cases recognised in accordance with the provisions of the Code of Civil Procedure, using technical equipment enabling them to be conducted at a distance with simultaneous direct transmission of video and sound during the state of an epidemic or epidemic hazard declared due to COVID-19 and within one year of the cancellation of the most recent one
  • holding of hearings by the Provincial Administrative Courts and the Supreme Administrative Court using technical equipment enabling it to be conducted at a distance with simultaneous direct transmission of video and sound during the state of an epidemic or a state of epidemic hazard declared due to COVID-19 and within one year of the cancellation of the most recent one
  • adding to the catalogue of entities entitled to benefit from the subsidy for the remuneration of employees by institutions having legal title to a monument with the status of a historical monument or a monument included in the World Heritage List
