Posting of workers in the EU – what facilities will the EU e-Declaration portal provide?
The European Commission is working on creating a new e-Declaration system. It is to facilitate the sending of posted workers abroad within the European Union. An element of the system is also to be an electronic social security card, which will allow to avoid the previous irregularities related to A1 certificates and will streamline inspections.

Unmanned aerial vehicles (UAVs). What has changed with the amendment to the Aviation Act?
In today’s reality, no one can deny that unmanned aerial vehicles (UAVs), which until recently were somewhat neglected and sometimes treated with a pinch of salt, are becoming an increasingly important user of airspace. In response to the rapid development of the UAV market, most of the provisions of the important amendment to the Aviation Act came into force in February.

Law on the labour market and employment services signed
The new Act takes over, with some changes, many of the previous solutions functioning in the Act of 20 April 2004 on employment promotion and labour market institutions, systematising them and at the same time introducing a number of new solutions.

The Act will enter into force on the first day of the month following the 14 days after its promulgation.

The President signed the Act on the conditions for allowing foreigners to work
The Act concerns the employment of foreigners in Poland, new legal solutions for higher penalties for illegally employing foreigners, streamlining of procedures, reduction of the backlog in offices and full electronicisation of proceedings. It also regulates special measures in the field of professional activation and social integration of foreigners, financed by the Labour Fund.
The Act consists of 11 chapters. It introduces a closed catalogue of forms of professional activity that foreigners may undertake. At the same time, it indicates the groups of foreigners to whom the provisions of the Act do not apply because inter alia their employment conditions are regulated by separate provisions of Polish law, directly applicable international agreements, generally accepted international customs or when their activity in Poland is of an incidental nature and is not related to the Polish labour market.
The Act will enter into force on the first day of the month following 14 days after its promulgation.

The Act on amending the Act on planning and spatial development announced
On 16 April 2025, the President signed the Act of 4 April 2025 amending the Act on spatial planning and development and certain other acts, and it was published in the Journal of Laws on 22 April. The purpose of this Act is to extend the validity of the existing municipal spatial planning studies until 30 June 2026. The original deadline was 31 December 2025. The amendment to the Act stipulates that these studies will remain in force until the entry into force of the municipality’s general plan, but no longer than the said 30 June 2026.
Consequently, the period of validity of the municipalities’ spatial planning and development studies will be extended by six months in relation to the original assumptions of the Act of 7 July 2023 amending the Act on spatial planning and development and certain other acts (Journal of Laws, item 1688 and of 2024, item 1824). The Act shall enter into force 14 days after its promulgation, i.e. on 7 May 2025.

Ministry of Finance plans changes to CRBR
The Court of Justice of the European Union (CJEU) was the first to challenge the existing rules in favour of strengthening the protection of individuals’ privacy. In response, the EU legislator introduced restrictions on access to beneficial owners’ records through Directive 2024/1640 (AML Directive6). Poland is currently working on the implementation of this directive and the Ministry of Finance has prepared a draft amendment to the Anti-Money Laundering and Countering the Financing of Terrorism Act (AML Act), which provides for changes to, among others, the Central Register of Beneficial Beneficiaries (CRBR). It is planned to introduce new rules for sharing data with public authorities. Above all, the register will no longer be open to the public in general, and access to it will be possible upon proof of legitimate interest.
