Government announces changes to defence system. A new model for military training is to be in place by the end of the year. Are these changes likely to require sweeping regulatory changes? Does the Labour Code provide solutions for situations where an employee has to undergo military training?
The government plans to train every adult male for war. Piotr Kryczek, counsel and labour law expert at TGC Corporate Lawyers, points out that the planned universal military training, if not integrated into existing forms of service, may require changes to labour law.
For the time being, the provisions of the Labour Code do not, as seems understandable, provide for exemptions from work or other benefits for the employee in connection with military training as announced by the government [according to the announcement, the form of training is to differ from the current ones – ed]. Though the enactment of the ‘Homeland Defence Act’ in 2022 introduced a number of additional entitlements for employees related to defence duties, these entitlements apply to those called up for active military service and support for those released from such service – explains TGC expert.
