Electronic delivery – a new obligation for companies

Every company obliged to use e-Deliveries must take care of efficient system management. This means, m.in other things, the need to appoint an administrator, monitor messages and take care of procedures.

What is electronic delivery?

E-Deliveries is a service that allows you to receive, send and store correspondence in electronic form. They replace traditional lists, making the exchange of information faster and easier. They work like a registered letter with acknowledgment of receipt, but in a digital version. 
 
Ultimately, all public institutions, companies and representatives of professions of public trust will be required to have an e-Delivery address and use it for official correspondence. 

The introduction of this new obligation will be a major challenge for entrepreneurs, among others due to the need to adapt the internal procedures for the circulation of electronic documents and to appoint a person responsible for managing the e-delivery box.  
 
Therefore, it is worth considering submitting an application for the creation of a mailbox with an e-delivery address as soon as possible to have time to adapt the company to the new rules of communication with state administration bodies, especially since there is less and less time to meet the new obligations.

Public entities

1.10.2029 Other public authorities, state control and law enforcement bodies and their budgetary units ZUS, KRUS and the funds they manage National Health Fund Executive agencies, budgetary management institutions, state special-purpose funds, public hospitals, public universities, Polish Academy of Sciences, cultural institutions and other public entities Local government units, metropolitan associations and local government budgetary establishments – in the scope of registered electronic delivery

Non-Public entities

01.01.2025  Persons performing professions of public trust (attorneys-at-law, legal advisors, tax and restructuring advisors, patent attorneys, notaries)

01.07.2025  Entities registered in CEiDG before 1 January 2025 – in the event of a change of entry after 30 June 2025 
01.10.2026  All entities registered in CEiDG before 1 January 2025 

E-Delivery – what do you need to know? 

  • The introduction of e-Deliveries means that entrepreneurs will have to adapt to the new rules. What does this mean for your business? 
  • Each entrepreneur should apply to the Minister of Digital Affairs for an individual address for e-Deliveries 
  • Setting up an e-Delivery address is possible now, even if the obligation does not yet apply to your company 
  • Each entrepreneur should choose a provider of registered electronic delivery services – it can be Poczta Polska (or one of the non-public providers entered on the list of Qualified Service Providers kept by the Minister of Digital Affairs) 
  • An entrepreneur other than a natural person must appoint an administrator of the e-Delivery box
